Last July, a group of Niwot residents and property owners filed for independent judicial review to overturn Boulder County’s approval of a recreational marijuana shop in downtown Niwot.
After the case was filed and accepted by the Court, the County as defendant compiled and certified the written record the Court will base its decision on. The record exceeds 10,000 pages and includes all written comments by the public, recorded public hearing testimony, all application materials, County staff papers, prior Cottonwood Park Square special use reviews and other records the Boulder County Attorney considered relevant such as the Land Use Code.
Arguments presented to Judge Norma Sierra will be in writing, based on the record. No court appearances or oral arguments occur. The plaintiffs’ opening brief is due February 10, followed by the defendant’s answer on April 10. The plaintiffs’ reply by to that on April 24 is the final submittal. Judge Sierra will rule after that when she is ready, which could be weeks or months.
