Marijuana Retail Operation in Niwot

 

The property located at 6924 N. 79th Street, formerly the Elysian Fields’ Click to enlargeauction house, has been purchased by a party that has applied to make it a marijuana retail operation.  A survey of NCA members has shown that the majority of people are against this.

  • The Boulder County Commissioners voted unanimously to approve SU-15-0001, the application for a retail marijuana dispensary in Niwot.  The only change to the Land Use / Planning commission recommendation was to include language that would allow the operator to apply for a change in hours of operation that could be handled administratively by Land Use and not require a public hearing.

  • The office of the Boulder County Commissioners announced that the public hearing on this issue will be June 29 at 2pm.  Public testimony will be taken.  They will not be announcing a decision at this meeting.At a followup meeting the next day, June 30 at 11am, the commissioners will discuss the issue and then announce their decision.  Public testimony will not be taken at this meeting.Both meetings will be web-streamed live.

  • The Boulder County Land Use Department posted its staff recommendation to conditionally approve the application for a marijuana retail business in Niwot.  Details can be view on the docket page (link is above).  They will present this recommendation at the Planning Commission meeting April 20, 2016.

2016-03-31:

  • The Boulder County Land Use Department confirmed that the marijuana in Niwot retail business application will be on the Planning Commission April 20, 2016 agenda. Public testimony will be taken.

2016-03-21:

  • The docket page was updated with a letter dated March 16, 2016 from the applicant, Colorado Real Estate Holdings, stating that they are modifying their application to be retail only, no cultivation.

2016-02-25:

  • Hannah Hippely of the Boulder County Land Use Department reports that it is likely that the Niwot Marijuana application will go before the Planning Commission at their April 20th meeting.

2016-01-29:

  • Hannah Hippely of the Boulder County Land Use Department reports that the Niwot Marijuana application will not make it onto the Planning Commissions February agenda pending the completion of independent traffic generation study by the Transportation Department.  Soonest that this could make it to the Planning Commission is now March.

2015-12-29:

  • Hannah Hippely reported that the Niwot Marijuana application will not make it onto the Planning Commissions January agenda.  Soonest that this could make it to the Planning Commission is now February.

  • The applicant, Colorado Real Estate Holdings LLC, ubmitted their response to the Boulder County Land Use Department’s request for additional application information.The Land Use department will accept public comment through Oct 23, 2015.

    Staff has determined that more information is required from the applicant before a determination on this proposal can be made. Staff will be drafting a memo requesting this additional information from the applicant. Once the applicant has provided the information, a determination on whether the revised/updated materials need to be sent out for a re-referral will be made.

A formal application has not yet been submitted to the Boulder County Planning Commission yet.  In the past few months the NBA and NCA have been in communications with the new owners and their attorney.  The owners will attend the Mar-10 NBA meeting (closed to public) to discuss their plans and how they have every intention of being a good neighbor and member of the Niwot community.  The NCA will have three representatives in attendance.

Based on what is learned at the NBA meeting, the NCA will decide next steps.  Tentatively planned is:

 

  • The NCA will conduct a new survey on this issue to see if opinions remain the same AND to solicit specific comments/questions to use at a possible public forum.  The results will also be forwarded to the Boulder County Planning Commission and Commissioners.
  • The NCA has suggested that the owners come to a public forum hosted by the NCA to meet with the community and explain their plans and gauge the local opinion.  They seem open to this idea.
  • Once we find out the timing for when the application will be submitted to the Planning Commission, we will be sure that the results of both last year’s survey and the new survey are submitted as public content.  Of course, we will send representation to every public hearing on the application too.

  • 250 people opened the email
  • 197 responded within one week, 214 overall
  • The report with full comments was submitted to:
    – Boulder County Commissioners
    – Boulder County Planning and was read into the official records
    – The real estate agent representing the buyers of the property
